Section H: Airtime and Data
1. Introduction
1.1 These Terms and Conditions apply when using Ubuntu Botho Mobile’s Services, activated through a prepaid SIM Card connected to the Ubuntu Botho Mobile Network.
1.2 By purchasing Ubuntu Botho Mobile’s Services, you agree to these Terms and Conditions, which may:
- Limit Ubuntu Botho Mobile’s liability or that of third parties.
- Create risks or liabilities for you.
- Require you to indemnify Ubuntu Botho Mobile or third parties.
- Serve as an acknowledgment of certain facts.
2. Definitions
2.1 Apparatus: Mobile devices capable of connecting to the Network.
2.2 Ubuntu Botho Mobile: Ubuntu Botho Mobile RSA (Pty) Ltd, a South African private company.
2.3 Ubuntu Botho Mobile group: Ubuntu Botho Mobile and its subsidiaries.
2.4 Ubuntu Botho Mobile Representative: Authorized individuals selling and activating Ubuntu Botho Mobile SIM cards.
2.5 Ubuntu Botho Mobile Services: Cellular telecom services and related offerings.
2.6 Network: Public mobile telecom system operated by Ubuntu Botho Mobile.
2.7 Regulatory Authority: ICASA or similar authority.
2.8 SIM Card: Card for accessing the Network.
2.9 Starter Pack: Includes a user guide and SIM Card.
2.10 Subscriber Identity Module Card: Same as SIM Card.
2.11 Terms and Conditions: These terms and any future amendments on the Ubuntu Botho Life website.
2.12 Value Added Services: Additional non-core services beyond standard voice calls.
3. Provision of Services
3.1 Register your SIM Card according to RICA with assistance from the Ubuntu Botho Mobile Representative.
3.2 After registration, insert your SIM Card into your Apparatus to connect to the Network.
3.3 Ubuntu Botho Mobile will activate and maintain availability of services.
3.4 Free access to the Ubuntu Botho Mobile App includes 100MB of data per day; additional usage may incur charges.
3.5 Ubuntu Botho Mobile may adjust or discontinue services with reasonable notice.
4. Cellphone Number Portability
4.1 Indicate your wish to port your number when registering. An admin fee may apply.
4.2 Porting restrictions apply in certain conditions.
4.3 Porting is not available on Sundays or public holidays.
4.4 Reversal of porting is allowed under certain conditions.
5. Changing Cellphone Number
You can change your Ubuntu Botho Mobile number without a new SIM card. Instructions are available on the Ubuntu Botho Mobile App.
6. Value Added Services
Subscribing to Value Added Services is subject to additional terms and conditions.
7. Disclosure of Information
Ubuntu Botho Mobile may disclose personal information as permitted by law to various entities for purposes including marketing, legal compliance, and auditing.
8. Acknowledgment
Service quality depends on Network conditions and physical factors. Ubuntu Botho Mobile is not liable for non-availability of services.
9. Liability
You indemnify Ubuntu Botho Mobile for any loss or damage arising from a breach of these Terms or use of services, except for losses due to gross negligence or misconduct by Ubuntu Botho Mobile.
10. Undertakings
10.1 Comply with Ubuntu Botho Mobile’s instructions and only use approved Apparatus.
10.2 Do not commercially exploit Ubuntu Botho Mobile Services without written consent.
10.3 Provide necessary information as requested by Ubuntu Botho Mobile.
10.4 Engage with Ubuntu Botho Mobile staff respectfully.
11. Suspension/Disconnection
11.1 Ubuntu Botho Mobile may suspend or disconnect services under certain conditions, with potential fees for reconnection.
11.2 Unused data or minutes are non-refundable upon disconnection.
12. Communication
You consent to receiving communications from Ubuntu Botho Mobile. You may opt out of marketing materials.
13. Disputes
Disputes may be referred to ICASA or the National Consumer Commission.
14. Lost or Stolen SIM Cards/ Apparatus
14.1 You are responsible for the safekeeping of your SIM Card and Apparatus.
14.2 Notify Ubuntu Botho Mobile and the South African Police Service immediately if lost or stolen.
14.3 Replacement procedures are available through the Ubuntu Botho Mobile App or a Starter Pack.
15. Password and One Time PIN
Keep your password or OTP secure. You are responsible for any unauthorized use of your account.
16. General
16.1 Governed by South African law, with disputes subject to South African courts.
16.2 If any provision is illegal or unenforceable, it will be deleted without affecting the remainder of the Terms.
16.3 Failure to exercise any rights does not waive them.
16.4 Amendments to Terms will be published on the Ubuntu Botho Life website.
Competitions
Introduction: Competitions are run by Ubuntu Botho Mobile RSA (Pty) Ltd.
Eligibility: Participants must be 18+, South African residents. Employees of Ubuntu Botho Mobile and their families are excluded.
Data Protection and Publicity: Personal information is handled per data protection laws. Winners agree to participate in promotional activities.
Limitation of Liability: Ubuntu Botho Mobile is not responsible for issues beyond its control. Competitions are not endorsed by any social media platforms.
General: Ubuntu Botho Mobile may cancel or amend competitions at any time. Governed by South African law with disputes subject to South African courts.
